No, it's a good point and well taken. The greater point this discussion has raised - namely, where do we separate civil law and the constitution - is certainly going to need to be addressed. I threw in a real-world example to sate why I think this should be a constitutional point: we would be adding two short bits saying who can speak where, which I still think is in the kind of category that makes it worthy of the constitution myself.
