I like it Chairman. Maybe to eliminate confusion we can even take it a step further (these include Chairmans revisions as well):

Mobility Laws:

Every resident of Hermertia has the right to safely enter, remain in, and leave Hermertia and its nether.
a) Overworld: They have the right to move freely in any and all regions of Hermertia and may not be restricted from entering, remaining in, or leaving any region except in times of war.
b) The Nether: The Hermertian nether is classified as international territory and may not be claimed as property and is governed only by international law. Structures built in the nether are treated as international property; any and all may build, but their work is public.
c) Nether Portals: Nether portals are defined as international property when created. They may be moved and broken by the person(s) that created the portal, except to inhibit the mobility of parties involved in a war. Nether portals must also be made safe for use within a reasonable time frame.

Notes:
- Remove the points in red as this contradicts some points below. Just break down the mobility laws into parts to avoid confusion.
- the points in blue were reworded to capture what actually is the case regarding the portals. We are in fact allowed to break portals except in times of war if we need to move them and such (just as Arjen has alluded to).

Just some thoughts.
